ATP Agri-Services, Inc. is seeking thirty-three (33) temporary full-time commercial truck drivers. The position includes a continuous tour of employment as a team or solo driver from April 1, 2026, through November 30, 2026, during the regular agricultural harvest seasons, including watermelon and pumpkins, etc. Drivers will transport bulk and packaged produce and agricultural packaging products throughout the southeast United States while adhering to all applicable commercial vehicle laws and regulations, returning to the worksite every 1-3 days. Drivers do not load or unload trailers.
The employer will provide at no expense to the driver, and the driver will be responsible for adequate care, all equipment and tools necessary to perform the employer's assigned job duties per 20 CFR 655.20(K). Daily travel requirements for this position include spending many on-duty and off-duty hours on the road in a semi-truck. Sleeper-cab semi-trucks include a bed, refrigerator and other amenities. Sleeper-cab semi-trucks will generally travel within a one (1) to eleven (11) hour radius, greatly dependent on traffic conditions, throughout the southeast United States and return to the worksite every one (1) to three (3) days. For safety reasons, workdays and daily work hours will vary as drivers are free to accept or to not accept a new dispatch order offered by the employer based on the driver's readiness and willingness at the time that the new dispatch order is offered by the employer, but the driver is expected to work approximately the maximum weekly number of days and hours allowable by the Department of Transportation (DOT) Hours-of-Service (HOS) regulations (49 CFR 395). Daily work hours will vary and may include 12 a.m. through 11:59 p.m. Workdays will vary and may include Monday through Sunday. Generally, drivers will work approximately sixty (60) to seventy (70) hours per week and approximately six (6) days per week at varied schedules to perform all job duties.
This position requires the driver to possess and maintain a valid commercial driver's license, Class A, or equivalent, as well as possess and maintain all requirements necessary to operate as a commercial truck driver in the United States. This position requires no minimum education level and no experience. No on the job training is required or provided.
An employer provided on-board camera system is required and shall not be disabled or obstructed by the driver. Driver's work schedule will be scheduled by the employer but the driver must accurately record and jointly manage their DOT HOS (49 CFR 395) with the employer. Drivers must conduct themselves in a professional manner at all times while performing job duties. The employer maintains strict rules regarding drug and alcohol consumption. Drivers must self-report to the employer the use of all prescribed medications that might affect the driver's performance of job duties. Drivers may not consume or be under the influence of drugs or alcohol within five (5) hours prior to starting the driver's job duties or while in the performance of the driver's job duties. No alcohol or illicit drugs are allowed on the employer's property. Drivers are subject to employer paid post-hire, post-accident, suspicion of use and random drug and alcohol testing. The employer provides semi-trucks equipped with a WIFI signal at the employer's expense. The driver is required to possess a personal hands-free phone system that adheres to DOT laws regulating all commercial truck drivers. The driver is required to log electronic work activity data and communicate with the employer daily via employer provided smart device app(s) (example, Electronic Logging Device (ELD) and Transportation Management System (TMS)). The driver is required to possess an active bank checking or savings account as all wages are paid to the driver via direct deposit.
A one (1) week period will be used as the standard for computing a weekly payday every Friday. The driver's wages will be based on the greater of a $30.63 per compensable hour basis or on a piece-wage per load basis. Accurate and timely driver activity records are critical to the employer's payroll process. The driver is responsible for accurately recording and timely submitting all paper and electronic (example, an upload or data entry into an employer provided app(s)) payroll wage documentation to the employer and the driver's payroll submissions must be consistent with all electronic recordings held by the employer (example, ELD, TMS, GPS records). An hourly overtime rate is not applicable per the Fair Labor Standards Act (FLSA) Exemption, Section 13(b)(1), and described in the Department of Labor (DOL), Wage and Hour Division's (WHD) Fact Sheet #19: Motor Carrier Exemption.
The employer guarantees to offer work for a number of hours equal to at least three-fourths (3/4) of the total hours consistent with the Job Order during each twelve (12) week period of employment starting after the driver's arrival on the first work date and ending on the driver's termination date of employment, unless the driver voluntarily terminates employment prior to the contract end date.
For drivers hired outside reasonable commuting distances to the worksite, whether in the United States or abroad, the employer will pay in advance or reimburse, within three (3) business days of the start of employment, the driver for the most economical and reasonable mode for all inbound transportation, lodging, visa, visa processing, border crossing and other inbound expense mandated by the government and incurred by the driver, but excluding passport expense and other related inbound expense primarily for the benefit of the driver. The inbound transportation and lodging expense will be deducted from the driver's subsequent wages in an amount consistent with FLSA regulations regarding minimum wage until the total expense is reimbursed to the employer or until the driver has completed fifty percent (50%) of the driver's employment period. Upon completion of 50% of the driver's employment period, the driver will be reimbursed for all inbound transportation and lodging expense previously deducted from the driver's wages as well as reimbursement for inbound subsistence expense incurred by the driver at a minimum of $16.28 per day and a maximum of a documented $68.00 per day, or the current amounts per regulation. Upon completion of the certified end date of employment, or upon termination of employment by the employer for any reason, the employer will provide or pay for the driver's expense of outbound transportation and daily subsistence from the place of employment to the place from which the driver, disregarding intervening employment, departed to work for the employer, consistent with CFR 655.20(J)(1)(II).
The worksite location is 5800 Cane Run Road, Louisville, KY 40258, Jefferson County, Kentucky. The employer does not provide free housing to drivers. Upon request, the employer will provide the driver with information to help the driver obtain local residency at the driver's expense. The employer will provide transportation to and from the driver's local residency and the worksite at no expense to the driver. Worksite amenities include overnight parking and bathroom facilities at no expense to the driver. Road-side retail amenities include overnight parking, bathroom and shower facilities, laundry facilities, lounge facilities, meal facilities, rest facilities and other amenities at the driver's expense, as is common in the industry. Due to the unique nature of both the occupation and the temporary period of employment, the driver will be allowed reasonable usage of their semi-truck for personal usage. Sleeper-cab semi-trucks are deemed by the DOL and the DOT as adequate sleeping facilities (49 CFR 393.76). For the benefit of the driver, the driver may be allowed continuous residency, i.e., a temporary home, within their assigned sleeper-cab semi-truck with reasonable usage of their assigned semi-truck to access near-by amenities. This driver living arrangement would allow the driver to avoid a higher expense for personal residency, but any employer paid expense for the driver's personal usage of the sleeper-cab semi-truck will be deducted from the driver's wages. Applicable deductions from wages will include $1.00 per personal mile driven and $5.00 per personal idling-hour for the driver's personal usage of their semi-truck.
All driver job duties are compensable and are common to the commercial truck driving industry.
